In my mind, since the members of Spirit did not sue when they were alive, this should be thrown out.

yes big waste of time and money. The 2 songs are nothing alike except for the first 8 bars. It's pretty ridiculous.

That's basically the same phrase or progression... you can't copyright a phrase can you?
Didn't it used to be that it was considered an honor for other people to use your songs? I think I remember reading something about a long tradition of borrowed and adapted songs that kind of ended in the 60's, or at least it began to go the way of having to pay to do it.

it's not even the same exact phrase. first 4 chords are the same then it changes.
It's an 8-minute song, with 15 seconds that sound like another song and 7:45 minutes that don't.

Let it Grow from Clapton is closer. It would make more sense to sue him. After the descendants of Spirit win the money, then the descendants of Davey Graham can sue for ripping off Cry Me A River. After which, the descendants of Giovanni Battista Granata can sue them for ripping off his Sonata for Guitar and Violin.
