Here's a surprising fact that I didn't know until I just looked it up: Blacks actually benefit from SYG defense, MORE than whites do, in Florida.

The media REALLY needs to stop reporting this stuff so one-sided. I don't remember the last time I read a SYG defense where the shooter was black, but it happens just as much.

I'm not saying that as a defense or distraction from white SYG defendants, I'm saying it because before I looked it up, my impression was that whites use that defense more than other races, and get away with it, because that's what you hear about. News is worthless.

That is surprising. I'm with you... I would have thought it was the other way around.

What annoys me is that at least on MSN video clip was edited so you can't see how much time is from when he pulls the gun until he fires it. Pretty important detail.



Thing is once he pulled the gun the guy backed off.... It really could have ended there... And if the guy tried to attack him again well then all bets are off... Shoot him



Agreed that if the attacker backed off, it's time to wait for the police to arrive and defuse the situation.

Like I said, from when he pulls the gun to when he pulls the trigger is crucial.

It seemed to me that part of the video was edited.

It looks to me like the pusher backs off when the shooter pulls the gun, and is backing off when shot.

I don't see how Fl. couldn't prosecute the shooter.

It usually takes imminent threat to justify a shooting.

There was imminent threat until he pulled his gun and the attacker backs off.

In a civilized world, there would have been a parking ticket, and assault and battery charge, and civil damages awarded to the shooter for injuries he received as a result of the push.

Too bad it ended this way.

It's kind of funny....I once knew a guy (he was an M.D.) who was perpetually pissed off about people who parked obnoxiously (you know, new car taking a handicapped spot so nobody will ding his door, etc.). He went to the police and asked them for the right to take pictures and submit them to the police. The police agreed to ticket whoever he turned in.

He backed off once he saw the shooter intended to shoot him


One should never draw their firearm unless they intend to shoot. Not to wave around and scare people. Once he committed to drawing his weapon he had already made the decision to shoot.

Moron dead guy was still bowing up after shoving the idiot parking lot wannabe cop to the ground. Bold move rewarded with death.

You're thinking self-defense laws. The burden of proof for stand your ground is much lower than self-defense.

FL can probably prosecute him if they chose to do so, but an actual conviction is very unlikely.

Pretty sure the State will step in and have Drejka arrested. I'm guessing that they will have to go to trial to demonstrate due process.

That would be a bold move for the DA, as it could open the door for victims of other SYG cases to have the cases reopened. They will most likely take the pussy option and convene a grand jury and whatever the grand jury decides will stand. But even with an indictment, it would be hard to prosecute the case under existing FL SYG laws, since there is video evidence and that evidence does align with the current SYG law, like it or not.

Not that I don't think the guy doesn't deserve it. One of the biggest problems with the FL SYG law, as it is currently written, is that it encourages vigilantism. Both Zimmerman and this guy have the wannabe vigilante thing in common (well and the fact they're both assholes). It's all legal under the current law though.

Reading more on Florida's SYG laws, looks like there was a change the last few years to being an aggressor in this instance. I can't comment any further without knowing what the dude was saying to the woman in the care, but it seems that SYG may not apply he was threatening her and that's why he was shoved to the ground.

I'm going to move to Florida so I can just shoot people I disagree with, then claim self defense... :facepalm:

I posit that the bully was not the big black guy. The bully was the coward with the gun. Same coward that has brandished his piece in public on multiple instances. He's only brave with his gun. He bullied the wife in the car, knowing he had his piece to protect him if her driver was scary. There are at least 3 open parking spaces on that video, no need to even have that conversation. When he received the first stage of what was going to be a grade A asswhoopin in a fair fight, he went right for that piece. Even though his attacker backed off he shot him. He's been wanting to shoot a no good parking space grabber for awhile and now he has, and now he'll get off scott free.

Crazy times man.
