Most folks hardly ever collect on insurance. That's why they are hugely profitable and why they used profits to get laws passed requiring insurance. Its the mafia protection plan and why the ACA wasn't able to get single-payer included. Have you seen the movie"The Rainmaker" Billy?

It's hard to know for sure because it's not 19k at 16 years. It's 19k over 16 years. Average 1200/year (less in the beginning and more now but that's the average charge per year).

They were charging her yearly and we didn't catch it because it wasn't coming out of her daily checking a count, we have a trust set up for her retirement income, properties etc and they were charging the trust account and just didn't catch it until now.

Even at 3% compounded interest, that's over $30k. Then include the "why did you give me this headache?" and "I shouldn't have to deal with this BS" fees, I don't think $40k is out of the question.

Yeah at this point we're just asking for what was charged to keep it simple. If they complain or try to drag their feet and we have to sue, then we're going for interest, damages etc so around 40-50k. Not to mention criminal charges.

But if they're willing reimburse her and send a check next week, we'll drop it because I really prefer to avoid a potentially long court case.

I think it's an easy choice for them to make but we'll see.

Man, I really hate shit like this. Glad you have a lawyer in the family.

My buddy had to take his health insurance company to court to get them to pay for his daughters hospitalization.
She's fine now but, she needed help getting her landing gear down for a few months.
The insurance company only wanted to pay for one week of treatment.
Luckily, my cousin won.

Lawyers are there for you to not have the headache....let the lawyers deal with it.

Your mom will come out ahead if you sue for zillions of dollars, a class action suit, criminal proceedings agains the CEO, etc.

None of that will happen, but it will make them sweeten the pot when making you an offer to get you to go away.
