This doesn't appear to be racist but I cant read minds. They parked in handicapped zone breaking the law. The other man confronted them as he has handicapped family. I have seen dozens of jerks take those spots and he probably did too. He decided to speak up. She got verbally abusive and escalated situation. Then her man comes out and does the crime of assault and battery . He had to feel threatened. In that state he had a right to defend himself.

I can only take a guess here so I'll wait for the State of Fl. , hopefully they sort out this one . IMO someone did not need to be shot in this situation...seems like someones / parties involved made a very bad judgement call .

Shooter was berating a woman in her car with kids. Didnt deserve that shove but he was definitely an asshole looking for trouble.

Fat guy, with gun balls, harasses a nasty woman for parking in a handicapped spot.
Big guy sees an opportunity to impress his girlfriend by shoving the fat guy.
Fat guy pulls a gun in self defense.
Big guy is no longer a threat because, he doesn't want to get shot.
Fat guy shoots unarmed big guy instead of trying to walk away, while pointing gun at big guy.
Mistakes were made on many sides. Manslaughter.

Yeah, looks like a mutualy unwise escalation... Good to call a fool out for using a handicap spot, but he shoulda called the fuzz.

Yeah, the guy pushed him down, but didn't appear to be coming at him after that. I don't think you should get to shoot someone because they hurt your feelings.

This.
We’ve had numerous gun discussions here and you guys all know where I stand; I carry and encourage others to safely, but man.
This is fuckin sad and just stupid.

I really think that law needs a clarification that if you are carrying a weapon as a civilian and have anything to do with the escalation of a situation that you're subject to not be covered under stand your ground if a gun or knife is involved. This isn't all that different from the Trevon Martin case. Some dude goes looking for trouble because he perceives some kind of wrong doing, gets some push back and then feels justified in shooting and basically gets away with zero accountability. The law is clearly incomplete.

Re: Murder or Stand Your Ground? Florida Edition 2.0
It was an assault. Even if shooter instigated the push that didn’t appear all that clear in the video so for that second he had the law in his favor.got assaulted save poor hc spot fucking hero. But now knowing he was instigating and perhaps harassing them he made the poor decision of shooting him. Btw for many people this is why you should not carry a firearm. Get pushed I’ll kill you .. fair right? Shit who wouldn’t be tempted to do that That guy pushed a good one. but This guy seemed busy though right. Hanging at the joint with his friends protecting that loan handicapped parking spot with a gun in his pocket. Wtf . What are you going to do Florida. We await your ruling .Good luck

Re: Murder or Stand Your Ground? Florida Edition 2.0
What happens to the stand your ground right for the guy that pushed the dude down? If he’s not in the right for pushing then how can the other dude be in the right for shooting?
Re: Murder or Stand Your Ground? Florida Edition 2.0
How ironic would it have been if the bullet didn't kill him, but severed his spinal cord, paralyzing him and giving him a handicap parking pass for life?

Re: Murder or Stand Your Ground? Florida Edition 2.0
I'm not going to say he should have shot. Tough call.
But drawing the gun was for sure called for in self defense.
Walk a mile in the shooter's shoes....
you need handicap spots for you/your family
you see someone illegally parked in "your" spot, and you tell the person that they shouldn't do that
Bitch girlfriend opens you a new hole about you telling her what to do
While bitch girlfriend is opening said new hole, you have a >250lb boyfriend blindside you, smacking you to the asphalt
You look up to see >250lb Mr. Friendly standing over......and I doubt he's apologizing....
You feel threatened and pull your gun to protect yourself.....
I would have done the same thing in the same situation.
I don't know what >250lb Mr. Friendly said when he pulled the gun, or if Mr. Friendly backed off or kept talking shit.
It makes a big difference
What annoys me is that at least on MSN video clip was edited so you can't see how much time is from when he pulls the gun until he fires it. Pretty important detail.

Christ, people forgotten the lost art of having a totally lame fight without pulling a fucking weapon. Maybe some fat dude will slap you around and maybe you'll get your nose bust. Does that really warrant killing someone?

Doesn't make sense to me. I can see the guy pulling his gun out BUT the man back off but he still shot him ??? He was no longer under a threat so he should have not shot him. This is when it becomes a police and court situation.

Bad idea-have you forgotten what bullies in school were like? You would give carte-blanche to every big dude with an attitude to pummel anyone they wished to. How about folks start being less selfish for a change and less like our leaders?

Re: Murder or Stand Your Ground? Florida Edition 2.0
Some of you don't understand Florida's Stand Your Ground law. It doesn't matter who pushed who first or who pushed who last. The law gives the shooter the right to use deadly force "if he reasonably believes that using or threatening to use such force is necessary to prevent imminent death or great bodily harm," without duty to retreat even if capable of retreating. The prosecution would have to prove that McGlockton shoved Drejka in an effort to get him away from his girlfriend, and then walked away and therefore it wasn't reasonable for Drejka to fear for his life. The D.A. did not feel he could prove this.
If you do not like the law, do not give money to the NRA or politicians who take money from the NRA. Do not vote for politicians who take money from the NRA or vote for their bills. Studies have found a 6.8% increase in homicides in states with stand your ground laws, with the largest uptick being white male shooters. Multiple studies have found that when participants believed that a "man in the images was black, they generally saw the man as larger, more threatening, and potentially more harmful in an altercation than a white person." This goes to the psychology of the shooter at the time of the shot fired and one possible cause to the uptick of white male shooters. These laws and America's fear of the immigrant and inner city and ghetto dweller will not change tomorrow or next week, but their is a groundswell and it will change eventually.
It should be discussed that Drejka was no saint, he did have a history of starting fights with people who parked in handicapped spots, even pulling a gun on one before. Probably a crotchedy old man, we have a lot of those in Florida. It is unfortunately not our largest export. Although we do export some in the late spring, unfortunately most come back in the Fall. Also, any intentional push of someone over 65 in Florida is a felony. This has been upheld by the Supreme Court of the State.

Thing is once he pulled the gun the guy backed off.... It really could have ended there... And if the guy tried to attack him again well then all bets are off... Shoot him

Re: Murder or Stand Your Ground? Florida Edition 2.0
This is a classic case where a gun showed up on a situation that should've been a fist fight at the most.
This is the kind of person who shouldn't carry a gun.
But FL law does give him the right of using his weapon when assaulted so it is what it is.

Dude was definitely putting his nose in someone elses business that had nothing whatsoever to do with him, but even still, you don't just instantly shove the fuck out of some stranger. Like I said in the FB group, the dude could have cracked his skull wide open on the concrete and died right there.
I think he jumped the gun (pun intended), but the law protects him. It is what it ain't.

We have no idea what the verbal exchange was , imagine it at it's worst though assume ugly and nasty as you could imagine and possibly threatening . The parking guardian should have called the law and not tried to enforce it himself it's not like he was breaking up a kidnapping or someshit . Whole thing could have and should have been handled differently .
